Scotland - Trip Advisor cannot be forced to disclose reviewer's identity
In the recent case of Clark v Trip Advisor, the Court of Session in Scotland held that it could not order TripAdvisor to disclose information about the identity of its contributors, because it did not have jurisdiction to do so. The owners of a guest house wanted to sue someone for defamation (libel) because of unfavourable and defamatory reviews by an anonymous contributor Trip Advisor, and asked the Court to order Trip Advisor to disclsoe teh reviewer's identity. The Court refused to make the order requested, as it said it did not have jurisdiction to do so.
