The German Regional Court in Essen has dismissed a claim for damages of 674 Million
Euros by Rustenburg Co. Ltd, a subsidiary of the Russian Sintez group, against RWE AG damages against RWE AG on 24 March 2015.Rustenburg Co. Ltd. The reason the claim was dismissed is because of the principle of res jucicata, as the matter had previously been determined by arbitration in London. However, there is a second case which is pending against the former CEO of RWE AG, for a similar amount of damages: this was not dismissed, because he was only a witness in the London arbitration, as opposed to having been a party to it.
